ABOUT THE SPEAKER

Tess Taylor

One of the nation’s leading authorities on careers in the music and record industries, Ms. Taylor has connected countless people to jobs and opportunities through her work in the US and abroad, cultivated collaborations for over two decades, helped launch hundreds of projects and several companies. If you’ve read Malcolm Gladwell’s best-selling book “The Tipping Point” then you may recognize her as a “super-connector,” the concept Gladwell coined to describe that unusual species of person who knows everybody. Says Hollywood Today Publisher & Editor Jeffrey Jolson-Colburn, “Tess Taylor is one of the great resources of the music business. She’s a walking job fair. She has amazing insights into where the business is going and combines that savvy with a Rolodex the size of an SUV.” These traits are at the core of the two organizations she founded, the Los Angeles Music Network (LAMN, est. 1988) and the National Association of Record Industry Professionals (NARIP, est. 1998). Ms. Taylor oversees initiatives of both organizations to promote career advancement, education and good will in the music and record industries. Headquartered in Los Angeles, NARIP has chapters in New York, San Francisco, Las Vegas, Phoenix, Houston, Philadelphia and London, with plans to launch more chapters in 2010.

Music Connection magazine says LAMN and NARIP are “top-notch and brilliantly executed” and named Ms. Taylor in its list of “50 Innovators, Iconoclasts, Groundbreakers & Guiding Lights of 2008” (Dec 2008). Last year, the World Championships of Performing Arts Board unanimously voted to honor Ms. Taylor with its 2009 Achievement Award and induct her into its Performing Arts Hall of Fame. Dubbed “International Music Ambassador” by music supervisor P.J. Bloom (Nip/Tuck, The Shield, CSI: Miami), Ms. Taylor works with groups such as the European Music Export Office, Danish Songwriters Guild, French Music Export Office, German Independent Label Association, the Brazilian Independent Label Association and others to connect their members to meaningful opportunities in Los Angeles and throughout the U.S.

Ms. Taylor has consulted leading businesses such as MySpace.com, InsideSessions (a joint venture between the Universal Music Group and Penguin Putnam, Inc.), The Walt Disney Company, BMG Entertainment (formerly Sony BMG), Concord Records and others. A frequently quoted analyst of industry developments, she has been a featured expert on international television and radio, and her analyses have appeared in national and international business press.

Along with workshops and seminars for her clients, she teaches “The Future of the Music Business… and YOUR Future In It,” a course she developed at UCLA, at institutions worldwide. The author of numerous articles and interviews with top record executives, she is at work on a book about the music business. A frequent keynote speaker and guest speaker at industry conferences and universities around the world, Ms. Taylor has lectured at the Harvard Business School, in Bangalore, Berlin and beyond. Later this year she keynotes at the Drucker Career Conference in Los Angeles and Trigger Creative Conference in Sweden, and lectures at the University of Vienna’s Institute of Popular Music in Austria. She has delivered dozens of keynote speeches and hundreds of lectures to thousands of people worldwide.

Deeply annoyed by people who think music should be free, Ms. Taylor is a vigorous defender of intellectual property rights and debated Electronic Frontier Foundation co-founder John Perry Barlow on “free music” at the University of Massachusetts at Dartmouth (2006) and was invited for a rematch at Ohio University (2008). She won both times. From 1988 to 1993 Ms. Taylor was employed at MCA Records, Inc., last serving as Associate Director of Marketing. A classically trained pianist, she studied music at the University of Vienna, and is a Phi Beta Kappa, Magna Cum Laude graduate of the University of Redlands’ Johnston College where she received her BA degree in music, German and literature. She loves traveling the world, nibbling dark chocolates and drinks lots of tea. She also loves fine fountain pens, anything written or recorded by Glenn Gould or Pete Townshend, gripping crime novels and hiking with her English cocker spaniel.

How to Pitch & License Music for Film, TV & Games

on Wednesday, March 23, 2011

in Atlanta

With declining record sales, the focus on placing music in film, TV and Games has skyrocketed. Placements are the new radio, and in this special program we invite top experts face off in a live negotiation of key deal points and contractual issues in a music license agreement.

We will also discuss marketing music for film and TV to make it more attractive to buyers, where to find them and how to put yourself in line for the best possible deal.

These experts come together to give you the inside track on major deal points, what they mean and what leverage you have to negotiate the best possible deal.

Most people think they can just hand a negotiation to a lawyer, and leave it at that. But as a professional, you need to be aware of the process and deal points, too, and what the implications to your artists’ careers may be.

Most importantly, you will see HOW a license deal is negotiated and be involved in the process.

Get educated about the art of deal-making!

YOU WILL LEARN:

The right time to make a deal.

Major areas of negotiation, including:

  • Terms
  • Options
  • Fee ranges
  • Deliverables
  • Clearances
  • Things to avoid
  • Closing the deal
Also:

  • Case studies: what works, what doesn’t and why

Prior to practicing law, Tony was involved in the entertainment industry as a manager, producer, performer and concert presenter.

Jonathan Earp, Esq., VP of Legal & Business Affairs, IODA Alliance

Jonathan Earp oversees IODA’s legal and business affairs. Jon has worked in the entertainment industry as an attorney since 1989, with an emphasis on digital products beginning in 2000. His client list has included digital B2C and B2B companies, entertainment websites, record companies, music publishing companies, film companies, recording artists, songwriters, and producers of music, film and television. Previously, Jon was an in-house attorney for Napster 1.0 (in their ill-fated attempt to become a fully licensed P2P system), Rhino Records, Paramount Pictures and NBC Studios USA/Universal Television. Jon is the author of numerous articles about the entertainment and new media industries, the author of the software package Automated Contracts for the Music Industry [Entertainment Publishers], and designer and teacher of the college course “Record Company Operation”. Jon earned his J.D. from the University of Southern California in Los Angeles, and resides in the Bay Area with his strong wife and above-average children.

Tom Murphy, Digital Media Technologist

A native “Bay Arean”, Tom grew up surrounded by technology and music. His dad designed Air Force spy satellites (later to become the foundation for Google Maps), and his mom was a classically-trained opera singer and teacher. Beginning with piano lessons in the third grade, he grew to be fascinated with synthesizers and sound recording in high school. This led to a degree in TV production, where he worked in both college radio and the local San Jose ABC-affiliate TV station. Upon graduating from Santa Clara University, he landed his first “real sound job” at Music Annex Recording Studios before taking the digital plunge. He joined Digidesign to support the launch of Pro Tools, represented the company on their CompuServe and AOL forums, and eventually launched their first website. ABOUT THE SPEAKERS

Roger L. Cramer, Esq., Selverne & Company, PLLC

Roger Cramer has been in music business since he was 17 years old starting as a DJ on college radio stations in his native Cleveland then later at the University of Michigan. It was at Michigan where he began promoting concerts and where he ran the university concert organization Eclipse Jazz. He had the good fortune to promote many of the jazz greats who performed in the late 1970s including Ella Fitzgerald, Count Basie, Sarah Vaughan, Oscar Peterson, Weather Report and Herbie Hancock, many of whom performed as part the Ann Arbor Jazz Festivals that Mr. Cramer organized. When he moved to New York City in 1981 he began managing artists, some of whom he met while working at Eclipse Jazz. He managed Shannon Jackson’s Decoding Society through whom he met Vernon Reid who later formed Living Colour. Roger managed Living Colour from 1984 until their break up in 1995. Jesse and his multi-faceted entertainment company, Mighty Loud have created and Executive Produced the smash TruTV series Full Throttle Saloon, a behind-the-scenes look at what it takes to run the world’s biggest biker bar in Sturgis, SD. Full Throttle Saloon was a top 5 cable program and pulled the highest ratings to date for the Turner network’s TruTV. Dupree previously acted as creator and Executive Producer of the Emmy-nominated MTV series Two-A-Days, and numerous pay-per-view specials including Sturgis Exposed and Mardi Gras Exposed, and the Dirt Poor Comedy Show. A versatile player in the entertainment industry, Jesse James Dupree is the General Manager for Kiefer Sutherland’s entertainment company, Ironworks, and a consultant for New West Records, best known for its roster which includes artists such as Dwight Yoakam and Kris Kristofferson, and the Live From Austin, TX series. Jesse has launched his own line of beer, Jesse James America’s Outlaw Beer which is featured prominently in the upcoming season of Full Throttle Saloon.

Rich Masio, Founder, The Department of Public Works

His clients include media companies that require digital and mobile strategy, distributors and record companies, and his services include domestic and international licensing for physical and digital deals. In 2005, after spending four years in leadership roles at two independent physical distributors, Big Daddy and Sheridan Square’s Musicrama/MDM Division, Rich joined IODA in its infancy. Traveling around the world, Rich licensed and managed top catalogs for digital distribution deals, including mobile and marketing support. He led the development of IODA’s foray into digital video distribution where he supervised content acquisition and helped strike deals with Apple, Netflix and Amazon while leading the company’s internal teams to support the category. Before IODA, Rich spent time at two other seminal online music companies, SonicNet and CDNOW.com. He worked for SonicNet, one of the earliest music social Web sites, which launched on the World Wide Web in April 1995. He worked in media relations, online marketing and managed monthly feature Action Ready Singles. He was Associate Producer of the Tibetan Freedom Concert’s online webcast in 1996, the first online event of its kind. SonicNet was sold to Prodigy Online during Rich’s tenure and ended up as part of Liberty Media and then Viacom/MTV Interactive. In 1997, Rich joined CDNOW.com as its 36th employee (the company ended up with over 450). Rich led product teams to expand editorial and merchandising areas, and supervised those teams before going on to help create what was then the first co-op advertising program for online music retail. He also helped CDNOW with its relationships with the major record companies and distributors. He settled into a business development role before CDNOW was sold to Bertelsmann in 2001. Prior to CDNOW, Rich was GM of Vermont-based indie rock label Safehouse which featured artists such as Half Japanese, Southern Culture on the Skids, The Volebeats and other alt-country and punk rock bands. Prior to SonicNet, Rich was a publicist at Formula PR where he touched the lives of clients such as Marilyn Manson, Nine Inch Nails, Wolfgang Press (one of Rich’s all-time favorite artists), Live and others. 2010-11-15 In NY – Bands, Brands & Beyond Expo
×
NARIP Presents
Bands, Brands & Beyond Expo

Connecting Consumers With Brands
Through The Emotional Power of Music

on Monday, November 15, 2010
at Cardozo Law School in New York, NY

Our Los Angeles Expo on this topic was sold out. Now we bring our full-day expo on this exciting topic to New York!

Using music to boost advertising and marketing can have enormous positive results for both brands and bands. In fact, matching bands (or music) with brands is one of the hottest and fastest growing areas of the business today.

Once taboo, brand associations and advertising are embraced by today’s savvy recording artists and their reps to increase exposure to their music and advance their careers. The Black Eyed Peas, for example, have been called “the most corporate band in America” (Wall Street Journal, April 16, 2010). Learn how will.i.am and the band became the face of Samsung, BlackBerry, Bacardi, Apple and Target.

Increasingly, advertising, brand and marketing executives need to know how to create win-win deals.

NARIP Presents “Bands, Brands & Beyond” Expo

That’s why NARIP has assembled some of the music, brand and advertising world’s top executives and deal architects to discuss how to pair music and artists with brands. These experts will guide attendees through the opportunities available and the complex rights area. They will provide insight into how to use brand association for new and established acts, how to create win-win deals and give a glimpse into what the future of music-in-advertising may hold.

How can artists and their reps access billion dollar brands? How can brands access appropriate talent? NARIP’s Expo will focus on how these deals are done, who does them, how they work and what they cost.

Deals done right and deals gone wrong will be examined in detail with case studies, checklists and proven templates. Attendees will receive information to identify and secure the right match.

Don’t miss this opportunity to meet top brand, ad and record executives, as well as artist reps who can help take your campaign to the next level.

You will learn:

  • How to “A&R” a brand and connect consumers to brands through the emotional power of music

  • Case studies, Coca-Cola with K’naan and World Cup 2010, and more

  • Selling in, not selling out: what deals make dollars and sense

  • How to prepare a brief and package ideas to attract and secure a brand

  • How to identify and secure an artist

  • How artists can add value to an ad campaign

  • Deal points: money, splits, fee ranges, negotiation tactics

  • Rights and licensing issues

  • Who puts these deals together, and how? Top deal-makers speak out

  • When art meets commerce: accommodations artists and brands must make

  • Alternatives to 360 deals

Some benefits you will receive:

  • Direct access to more than 100 music, marketing and brand execs from over 30 top music companies and ad agencies

  • Demystify deal-making in the music business – learn which rights you need to proceed

  • Take home a rule book for success, including case studies, checklists, deal points, do’s and don’t’s to create successful promotions and marketing campaigns with music

  • Get a sneak preview of the range of music properties available and see what’s in development

ABOUT THE SPEAKERS (in alphabetical order)

Cheryl R. Berman, Founder, UnBundled Creative

In her three-decade Leo Burnett career, Cheryl Berman was responsible for the majority of the agency’s most successful and famous marketing efforts. As Chairman and Chief Creative Officer of Leo Burnett USA, Cheryl held Leo’s own original job. She played a vital role bringing in more than half the accounts residing at the agency when she left, including McDonald’s, Disney, Hallmark, PetSmart, Altoids, Turner Classic Movies, Coca Cola, Kraft Foods, and ConAgra. Cheryl has always championed results driven work. For the last ten years under her leadership, Leo Burnett was the single most awarded agency for effectiveness. Cheryl is a role model for women. In 2004, she struck a chord with the concept “Miss Understood: She’s Not Buying Your Ads,” which debuted at the International Advertising Festival in Cannes. Cheryl continues to speak on this topic around the world, receiving acclaim from CNN, The Wall Street Journal, The Economist and Reuters. Cheryl has frequently written award-winning original music for brands like McDonald’s, Disney, Hallmark and Kraft. In 2005, she introduced Burnett’s Artist in Residence Program to build face-to-face working relationships between popular artists and the agency, thereby streamlining musical solutions and facilitating unique opportunities for marketers. The immediately successful approach was embraced by clients including McDonald’s, Kellogg and Nintendo, and was featured in Business 2.0, Billboard and The Wall Street Journal. A former journalist, Cheryl joined Leo Burnett as a copywriter. Proving herself to be a prolific writer and able manager, she became the first woman appointed to Burnett’s Board of Directors. She has received industry accolades including Chicago’s Ad Woman of the Year. She was featured as the “Determined Ms. Berman” in The Wall Street Journal’s Creative Leaders series. In 2008, Cheryl and her partner Tom Dickson launched Unbundled, a revolutionary concept in marketing services. Unbundled is a creative company that has shed the constraints of the traditional ad agency to offer world-class brand building to clients of all sizes. In addition to running the company, Cheryl reviews “Mad Men” for the Wall Street Journal. A Chicago native, Cheryl graduated from the University of Illinois with a bachelor’s degree in journalism. She and her husband Randolph Kretchmar have three children, who provide Cheryl with the insights and inspiration to keep her on her toes. You can visit her website at unbundledcreative.com

Tena Clark, CEO & Chief Creative Officer of DMI Music Media Solutions; Composer/Lyricist

What musical touchstone does President Barack Obama, the most powerful ruler in the world, share with Aretha Franklin, crowned the greatest singer of the rock era by Rolling Stone Magazine? The answer is the music expertise of Tena Clark. The company she founded, DMI Music & Media Solutions, programs the President’s music for Air Force One, and Clark also recently produced the Queen of Soul’s most recent album. Patti LaBelle, Aretha Franklin, Chaka Khan, Natalie Cole, Jennifer Holliday, Gladys Knight, CeCe Winans, Dionne Warwick, Patti Austin, Stephanie Mills, Yolanda Adams and Rev. Shirley Caesar are among the iconic recording artists for whom Clark has written and/or produced. In 2009, Natalie Cole was honored with two GRAMMY awards for Still Unforgettable, executive-produced by Clark. A musical compass has guided Clark from rural Mississippi to Hollywood. Beginning at age five, she would visit New Orleans with her mother, a songwriter from the big band era, where she absorbed the city’s intoxicating rhythms. Her first professional gig at 15 was playing drums at the Crescent City’s famed Roosevelt Hotel. Since then, Clark has excelled in multiple genres across an breadth of mediums. Highlights include penning award-winning country hits, contributing to multi-platinum movie soundtracks including Hope Floats, The Five Heart Beats, Where the Heart Is, and My Best Friend’s Wedding, writing for television shows like Desperate Housewives, and creating the instantly recognizable national campaign theme, “Have You Had Your Break Today,” for McDonald’s. In homage to her musical and spiritual roots, Clark produced Church: Songs of Soul and Inspiration that included classic soul artists like Patti LaBelle and Chaka Khan plus contributions from Pulitzer Prize winner, Dr. Maya Angelou and Toni Morrison. A stratospheric anthem from this collection, “Way Up There,” written and produced by Clark and performed by Patti LaBelle, was nominated for a GRAMMY award. “Way Up There” was originally commissioned by NASA as their theme song. Clark, a preeminent songwriter, is one of the rare female producers in the music business, and is among the most influential women in American media. Recently, Clark was named “Entrepreneur of the Year” by the Committee of 200, a prestigious group of the highest ranking women executives in successful private and public companies. Also, Clark recently launched “Twist, An American Musical” to rave reviews in Atlanta; Clark is the composer and lyricist. “Twist” was directed and choreographed by Debbie Allen. As CEO/Chief Creative Officer for the industry leader DMI Music & Media Solutions, the company she envisioned 13 years ago, she is involved with every imaginative aspect of the forward-thinking firm’s endeavors.
