ABOUT THE SPEAKERS:
Jon Bergen, Founder, Bender Music Group
Jon Bergen has worked in an executive capacity at major labels in sales and marketing, helping both major and independent artists shape their labels and careers. His experience includes retail music sales, strategic advertising, point-of-purchase, marketing campaigns, Internet promotions and national product placement campaigns, as well as helping connect bands with appropriate labels and vice versa. Jon has helped labels structure a staff and build them from the ground up. While at Mercury Records Jon worked with such artists as Hanson and Kiss to name a few before heading to Restless Records where he helped develop and market artists such as Warren G. and Spain. He then served as West Coast Director of Sales and Marketing Manager for BMG (later UNI) distributed Beyond Records where he promoted artists such as Blondie, The Go-Go’s, Veruca Salt, Lucy Pearl and Motley Crue. Jon was also the National Sales Director for the Sony-distributed Gold Circle Records, promoting product for such artists as Meredith Brooks, Roland Orzabal, Pat Benatar, Jeff Lorber and John Waite. Jon currently owns Bender Music Group, a premier online marketing company that works with labels such as Rhino, Warner Nashville and KOCH among others. Bender Music Group can supplement a record label marketing staff or become their staff. Bender also manages bands and consults labels and artists on all music business related matters.
JASON COOCHWYTEWA
Jason Coochwytewa is President of Red Note, Inc. With a diverse background in the advertising and marketing industry of 14+ years, Jason Coochwytewa began his work in entertainment in 2000 as an executive at a large-scale Native American casino in New Mexico. It was here that Jason was introduced to the “business-side” of the music industry: booking, marketing, and creating casino promotions around major national headlining acts. However, his appreciation for music in the art form was discovered as a young boy. Deeply rooted in his Native American culture, his father sang and taught him traditional Hopi songs, emphasizing the importance of listening to the words, rhythm and beat. Time spent with his father laid the foundation to what would eventually become Jason’s passion in life: music.
In 2005, Jason launched Red Note, Inc. based in Phoenix, Arizona, and now works full-time planning and managing intimate to large-scale event productions and promotions including festivals and headlining music concerts. Jason has been involved with over 100 shows, working with legendary to “fresh on the scene” musicians and bands. In 2008, Red Note, Inc. produced two major events during Super Bowl XLII; the Arizona Indian Festival with estimated audience of 20,000 and the Native American component of the NFL’s Super Bowl XLII VIP Tailgate Party for 10,000 individuals. Jason serves as a juror on the Canadian Aboriginal Music Awards and is an advisory board member for the launch of the World Indigenous Music Awards set to take place in 2010 in Canada. He is a graduate of Arizona State University with a Bachelor of Science in Marketing, and is an alumnus of Valley Leadership – Class 26. He currently serves as the National Association of Record Industry Professionals (NARIP) Phoenix Chapter Director, is a Board of Trustee with the Arizona Science Center and a board member with both the Girl Scouts of America Arizona Pine Council and the American Indian Chamber of Commerce of Arizona. Jason once again serves as co-chair of the Arizona Diamondbacks Native American Day on July 12, 2009 at Chase Field in Phoenix, Arizona.

Jason Feinberg is the president and founder of On Target Media Group, a music industry digital marketing agency. OTMG has marketed artists such as The Pixies, Har Mar Superstar, Flipper, George Thorogood, Steve Vai, Neil Young, John Coltrane, Ringo Starr and many more. You can follow Jason on Twitter @otmg.

Steffen Franz aka Stand Out Selector
Stand Out Selector, aka Steffen Franz, combines the best of art and business with his eclectic background.
With major changes in the modern music industry, independent artists and labels seek new ways to get their music out. Steffen noticed these issues as he himself has faced distribution challenges, too. He launched Independent Distribution Collective in 2004 and since then has grown the company from 9 labels to over 250 labels with close to 300 releases in less than 5 years. In addition to launching a physical distribution company, which now includes both digital, film and DVD distribution, SOS has also developed services like “InstantDistro” a turnkey marketing and promotion service, and “A La Carte Management” which helps advance the independent music community and educate developing artists.
A dancehall innovator, a DJ / producer / remixer and the owner of PSM Recordings, he has been bringing his conscious reggae vibes to throngs of people from New York to the Hawaiian Islands (and San Francisco in between) for almost 2 decades. A New York City native, SOS moved to Maui in 1991 where he broke the freshest dancehall tracks to scores of locals as well as tourists from around the globe at Studio 505, a Stephen Stills’ nightclub. At that time he also managed and produced Marty Dread & Culture Shock, the most popular reggae band in the islands.
1993 brought him to San Francisco to play venues like Miss Pearl’s Jam House, Kennel Club and others. Together with former partner Stefan G. (video/multimedia specialist), a brand new concept in global sound systems was formed: Positive Sound Massive. PSM features an array of international vocalists, rappers, toasters and musicians, including rapper Wookie J., whom SOS imported from Maui.
In the late 1990s, SOS DJ-ed at hundreds of shows throughout California, Nevada, Washington, New York, Australia and New Zealand where he opened for the Beastie Boys “Hello Nasty” World Tour. He has produced dozens of multi-artist stage shows and the Nicodemus “Dancehall Giant Tour,” as well as the Rocker-T “If Yu Luv Luv, Show Ya Luv” national US tour featuring Shinehead and Sleepy Wonder. He has remixed tracks for artists such as: Barrington Levy “Work” (MCA), Capleton “Wings of the Morning” (DefJam/RAL), Beenie Man “Tear off Mi Garment” (Island JA); and produced tracks for artists Nicodemus, Shinehead, Ras Michael, Barrington Levy, Rocker-T, Jamalski, Wookie J., Karney, DJ Collage, Poetz4Peace, and SF local hip hop group New Dealers.
SOS worked as Reggae Buyer for Rough Trade Records in San Francisco, and as Reggae Editor for American Music Press, a Bay-Area music monthly. From 1994 through 1998, Steffen was the Production Manager for the Paradise Lounge and Transmission Theater in San Francisco and still found time to write and review for independent publications. He has tour managed Mix Master Mike, traveling the globe on both of Mike’s solo tours and with the Beastie Boys. SOS also fronts an alternative rock group Crocodile Tears, plays bass in a Stoner Rock band called Not For Not, and is a member of “biL” – a dancehall, surf, hip hop, who-knows-what else conglomeration of excellence.
SOS is the founder of Positive Sound Management. PSManagement represents Rocker-T, Poetz4Peace, Haji Mike, Ian Collins and Karney, exclusively, and consults a number of other established and developing artists.
Recent studio works include production for over a dozen artists and bands. Production and Engineering credits include Nuffsed, Rastrillos, Haji Mike, Jahson Ites and new releases from Essential I and a compilation which includes music from Jahson Ites, Lutan Fyah, Essential I, Chezidek, Ms Triniti, Adrian Xavier, Halfpint with Ishi Dube, Ras Attitude, Promoe, Huckleberry, Prezident Brown, Norrisman with Jah Sun, Wisdom, Oren B Scripture, Haji Mike and Rocker T for Sick Donkey Records.
Steffen teaches Music Business 101, 110, 301 and 310 @ Pyramind in San Francisco.

Steve Schnur
As Worldwide Executive of Music and President of Artwerk Music Group for Electronic Arts, Steve Schnur is responsible for the pursuit, creation and continuous development of the global vision for music in EA games. He has brought established stars, breakthrough new artists and award-winning composers to top-selling EA franchises, changing the industry’s perception of video games from simple licensing opportunities to a series of groundbreaking and award winning scores and soundtracks. His hands-on approach with composer selection and score production has earned EA over 50 soundtrack nominations over the last 8 years. His extensive relationships with major recording artists and music managers have helped to create a series of original compositions which now fill the EA music library with valuable copyrights. Steve brought this vision into the multi-billion dollar game space from his experience in both the film and recording industries as a successful music supervisor and music producer.
In 2005, he created EA Recordings, a digital record label focused on the distribution of EA’s enormous collection of scores and songs. In 2008, he formed Artwerk Music Group, through which EA now directly signs, develops and launches artists for publishing, master recordings, sync deals and distribution.
Prior to joining EA in 2001, he held various executive positions with the Warner Music Group, MTV, EMI and BMG, and has supervised and produced music for films including CRUEL INTENTIONS and MISS CONGENIALITY (which garnered a Golden Globe nomination for best original song).

In LA – Art of the Music Deal: Mock Negotiation of 360 Record Deal
×
You are cordially invited to NARIP’s
ART OF THE MUSIC DEAL:
What Happens Before You $ign on the Dotted Line?
Mock Negotiation of
a 360 Recording Agreement
on Tue, Oct 27, 2009 in Los Angeles
With major changes in recording agreements over the past three years, multiple rights or so-called “360 deals” have become more common. In this latest installment of NARIP’s “Art of the Music Deal” series, two top music business attorneys and an artist manager face off in a live negotiation of key deal points and contractual issues that affect an artist’s rights and income, and a record company’s ability to acquire and monetize additional rights.
These experts come together to give you the inside track on major deal points, what they mean and what leverage you have to negotiate the best possible deal.
Most people think they can just hand a negotiation to a lawyer, and leave it at that. But as a professional, you need to be aware of the process and deal points, too, and what the short- and long-term implications to your artists’ careers may be.
Most importantly, you will see HOW a 360 deal is negotiated and be involved in the process.
Get educated about the art of deal-making!
You will learn eight (8) major areas of negotiation for record deals:
1. Artist advance / recording fund
2. Controlled composition clause
3. Guaranteed release clause
4. Pay or play clause
5. No cross-collateralization / separate “pot” for mastertone, voicetone and DVD monies
6. Tour support / marketing and promotion commitment (videos, etc.)
7. Artist royalty and royalties payable on foreign sales
8. 360 deals: try to limit other ancillary rights (i.e., merchandise, publishing, touring, sponsorships, etc.)
This program will also cover:
– Multiple rights: what are they?
– How to minimize a record company’s involvement in additional rights
– How to obligate a record company to monetize additional rights and maximize returns from a 360 deal
– Important deal points including new 360 provisions, ancillary rights, digital royalties, a discussion of the new publishing royalty rates for mobile, digital downloads, and interactive streaming services.
– The right time to make a deal
– 360 deals for developing artists

ABOUT THE SPEAKERS
CHRIS ARNSTEIN
Chris Arnstein is CEO of the Arnstein Organization, performing personal and tour management, record, TV, video and production, talent booking services, product branding, international marketing, multi-media promotions, music supervision for his clients. Arnstein has developed, toured and worked with stadium and arena-level acts such as Julio Iglesias, Michael McDonald, Natalie Cole, Jennifer Lopez, Air Supply, Bad English, Brett Michaels, Rachelle Ferrell, Sam Kinison, Madonna, Journey, Stevie Nicks, John Waite, Joe Walsh, Styx, ELO, The Eagles and others.
JASON COOCHWYTEWA
Jason Coochwytewa is President / Owner of Red Note, Inc.

Harness the Power of an Independent Commissioned Sales and Marketing Agent to Exploit and Monetize Your Music!
A NARIP Series: Intimate Pitch Meetings with Top Synch Agents
This Event is SOLD OUT
Is your music getting to decision-makers – people who can say YES and write a check?
The Synch Agents* featured in NARIP Pitch Sessions are among the top sales and marketing executives who actively place music owned by songwriters, composers and independent music publishers.
Many music buyers – directors, producers and music supervisors – name these Synch Agents as among their go-to music providers. These Agents, who NARIP has researched and interviewed, have placed thousands of songs in blockbuster films, hit television shows, trailers, global promotion and advertising campaigns, and video games.
At NARIP’s intimate sessions, you get to meet and pitch Synch Agents for current placement opportunities and representation, and get immediate feedback.
Come meet these career-makers.
BACKGROUND
Since 2011, NARIP Music Supervisor Pitch Sessions have secured over 1,000 placements in blockbuster films, hit television series, global promotion and advertising campaigns, and trailers for NARIP members.
NARIP members have also secured publishing deals and formed creative collaborations too numerous to mention as a direct result of these NARIP’s Sessions.
Topics
- Trends in synch licensing and agent deals
- Exclusive, non-exclusive, single-song deals
- Budgets and fee ranges
- Royalties, copyright ownership, rights retention
- Fees and deal points between synch agents and their clients
- Which synch agents seek a transfer of copyright(s) for their services, and under what circumstances
- Song re-titling
Small, focused NARIP Sessions enable one-on-one time and immediate direct feedback to music presented by participants. At hundreds of NARIP Sessions, we asked every guest music supervisor how to better market music to them. Their one consistent piece of advice? Get representation!
At NARIP Synch Agent Pitch Sessions, limited to 16 people, you get to know the synch agents and they to get to know you.
Most important, attendees meet these key players, paving the way for possible representation and ongoing opportunities, and giving them an edge in a competitive market.
* Synch Agent: A synchronization or “synch” agent represents music copyrights – either the composition, the sound recordings, or both. They pitch music to buyers and their representatives, including to music supervisors. Synch agents are typically compensated on a commission basis and do not own or control the copyrights they represent. While synch agents usually focus on entertainment and media exploitations, traditional songplugger services also include placement of represented songs with recording artists.
WHAT TO EXPECT AT A NARIP SYNCH AGENT PITCH SESSION:
PREPARATION IS KEY
As with NARIP Music Supervisor Pitch Sessions, NARIP’s Synch Agent Pitch Sessions are limited to an enrollment of just 16 people. About one week prior to NARIP’s Session, all registrants will get a brief of the guest’s then-CURRENT music needs. Each registrant will have a chance to pitch in response to the music briefs provided and get immediate feedback to music pitched. Each participant must submit 7 songs (MP3s only please) 36 hours prior to NARIP’s Synch Agent Pitch Session. Please note that due to time constraints you will only be able to pitch your TOP 3 songs for consideration and immediate feedback (more, if time permits). This process takes the mystery out of why a piece of music does or doesn’t fit. On-the-spot feedback enables registrants to re-work tracks and re-submit, which creates a much higher probability to get them licensed (choose well!).
If you do not have music that matches the current needs of the guest, fear not! You can still attend and present the top three songs in your catalog. Make sure the songs are unique and captivating. This is helpful because a music supervisor’s needs change constantly. To optimize impact of music you pitch at NARIP’s Synch Agent Session, we highly recommend that you target the briefs.
In addition to pitching for current placement opportunities, NARIP’s guest Synch Agents will consider music pitched for representation.
Good luck and see you there!
BEFORE NARIP’S SYNCH AGENT PITCH SESSION:
- NARIP prepares a one-sheet for each participant including your photo and bio for the guest to use and review at the event, and to take with him after the event. We will request your photo and bio one week prior to the event. In preparing these materials, we recommend you focus on brief career highlights in your bio and have a professional photo available.
- Approximately 5 to 7 days prior to NARIP’s Session, you will be sent a project brief describing several cues needed for a current project(s) of our guest speaker. These often include reference songs or links so that you can hear exactly what he seeks or needs to replace.
- You will submit your tracks with writer, publisher and other rights holder information that will also be supplied to the music supervisor during and after NARIP’s Session.
- You will get submission and meta-tagging guidelines, and mentoring as to how best to prepare your music for submission.
DURING NARIP’S PITCH SESSION:
- You will get to play at least three songs (sometimes more, if time permits) for the guest music supervisor who will provide feedback to you for each one.
- NARIP moderator asks very specific questions to help participants learn and understand how to modify their tracks to make these more place-able for the guest supervisor’s specific needs at hand.
AFTER NARIP’S PITCH SESSION:
- NARIP provides guest music supervisor with participant one-sheets and all music from NARIP’s Session, including notes detailing the guest music supervisor’s interest in specific tracks.
- If requested by guest music supervisor, NARIP conveys additional tracks, remixes, instrumentals etc. to him.
- If approved by guest music supervisor, NARIP provides his contact details to registrants.
DON’T GET LOST IN THE CROWD: SMALL IS THE NEW BIG
NARIP Sessions are deliberately kept small and intimate, which is just one reason they work so well and why participants have enjoyed over 1,000 placements to date. Limited enrollment of 16 people per session guarantees that registrants meet and get face-time with our guest.
OVER 1,000 PLACEMENTS FROM NARIP MUSIC SUPERVISOR SESSIONS
Our small format works! NARIP Session participants have placed over 1,000 tracks as a direct result of NARIP Music Supervisor Sessions. Other benefits include new publishing deals for NARIP members, creative collaborations and co-writes, strategic introductions to other music supervisors and placement experts, new representation for composers and much more.
NARIP’S BIGGEST PLACEMENT TO DATE : VODAFONE
Click here to read about NARIP’s biggest placement to date in a Vodafone campaign (Oct 2014) that paid handsomely and launched a career. Other brand placements include McDonalds and AT&T ads, among others.

ART OF THE MUSIC DEAL:
What Happens Before You $ign on the Dotted Line?
How To Market & License Music For Film & TV
on Tuesday, September 22, 2009
in New York
With declining record sales, the focus on placing music in film, TV and other media has skyrocketed. Placements are the new coin of the realm, and in this latest of NARIP’s “Art of the Music Deal” series, four experts face off in a live negotiation of key deal points and contractual issues in a music license agreement.
We will also discuss marketing music for film and TV to make it more attractive to buyers, where to find them and how to put yourself in line for the most favorable possible deal.
These experts come together to give you the inside track on major deal points, what they mean and what leverage you have to negotiate the best possible deal.
Most people think they can just hand a negotiation to a lawyer, and leave it at that. But as a professional, you need to be aware of the process and deal points, too, and what the implications to your artists’ careers may be.
Most importantly, you will see HOW a license deal is negotiated and be involved in the process.

ART OF THE MUSIC DEAL:
What Happens Before You $ign on the Dotted Line?
How To Market & License Music For Film & TV
on Tuesday, August 18, 2009
in Phoenix
With declining record sales, the focus on placing music in film, TV and other media has skyrocketed. Placements are the new coin of the realm, and in this latest of NARIP’s “Art of the Music Deal” series, music attorney James Marovich and music publisher / placement expert Les Scott face off in a live negotiation of key deal points and contractual issues in a music license agreement.
As a special bonus, Les Scott will also discuss marketing music for film and TV to make it more attractive to buyers, where to find them and how to put yourself in line for the most favorable possible deal.

YOU WILL LEARN:
The right time to make a deal.
Major areas of negotiation, including:
- Terms
- Options

He provides business, intellectual property, and contract law services for singers, songwriters, musicians, bands, independent film companies, publicists, actors, talent and modeling agencies, authors, artists, photographers, physicians, medical spas, theatre companies, talent management, and record sales and distribution services companies.
Prior to legal practice, Mr. Marovich had over twenty years of senior hospital administrative experience.
